1. About the Platform

(a) Welcome to www.echo-health.ai (the "Website"). The Website provides AI-powered clinical documentation and communication tools (the "Services").

(b) The Website is operated by Visualisation Hub Pty Ltd, trading as Echo-Health. By using, browsing, or accessing the Website or Services, you confirm that you have read, understood, and agreed to these Terms of Service ("Terms"). If you do not agree with these Terms, you must stop using the Services immediately.

(c) Echo-Health reserves the right to amend these Terms at any time by publishing the updated version on the Website. We will use reasonable endeavours to notify users of material changes.


2. Acceptance

You accept these Terms by either remaining on the Website or by clicking to accept the Terms when prompted. These Terms form a binding agreement between you (the "User") and Echo-Health.


3. Subscription and Account Registration

(a) Access to the Services requires a valid subscription ("Subscription"). Subscriptions are available via the Website and are subject to the published fees ("Subscription Fee").

(b) When registering, you may be required to provide personal information such as your name, email, specialty, and practice contact details. You agree that all information provided is accurate, current, and complete.

(c) You must be of legal age to enter into a binding agreement and must not be prohibited from receiving Services under Australian or New Zealand law.


4. User Obligations

As a user of Echo-Health, you agree to:

  • Use the Services only for lawful purposes;

  • Keep your account credentials secure and confidential;

  • Notify us immediately of any unauthorised access;

  • Not misuse the platform for commercial spamming or unlawful data scraping;

  • Not reverse-engineer, reproduce, or redistribute any part of the Services unless permitted.


5. Payments

(a) Payments are processed via Stripe and subject to Stripe's own terms.

(b) You authorise Echo-Health to charge you based on your Subscription plan, including overage fees if you exceed included usage.

(c) We may change our Subscription pricing with notice at the end of your current billing cycle.


6. Refunds

Refunds are granted at Echo-Health’s discretion, typically only if we are unable to continue providing Services. Refunds will be proportional to unused Subscription time.


7. AI and Usage Policy

(a) Echo-Health uses artificial intelligence to assist with clinical documentation and communication. All AI-generated content must be reviewed and approved by a qualified healthcare professional.

(b) Echo-Health does not provide medical advice or act as a clinical decision-making system.

(c) The User is solely responsible for verifying and validating any output before it is used in a clinical or patient-facing context.


8. Intellectual Property

All content, code, and materials on the Website and within the Services are owned by Echo-Health or its licensors. You may not copy, distribute, or commercially exploit any part of the platform without express permission.


9. Privacy and Data Handling

Use of the Services is subject to our Privacy Policy and Data Processing Agreement (where applicable). These documents govern how we collect, store, and use personal and health data.


10. Limitation of Liability

Clinical Responsibility and Consequences of Misuse
The Services provided by Echo-Health, including AI-generated notes, summaries, and documentation, are designed to support—not replace—the clinical judgment of qualified healthcare professionals. You acknowledge and agree that:

  • All content generated by the platform must be reviewed and verified by a licensed medical professional before being relied upon in any clinical, legal, or patient-facing context;

  • Echo-Health does not make clinical decisions, provide medical advice, or issue treatment recommendations; and

  • You remain solely responsible for any clinical consequences resulting from the use or misuse of the Services, including reliance on any incorrect, incomplete, or unreviewed content.

Limitation of Liability for Patient Harm
To the fullest extent permitted by law, Echo-Health disclaims all liability for any loss, damage, injury, or adverse outcome experienced by a patient or third party as a result of:

  • The use of unverified AI-generated content;

  • Any failure by the User to review, validate, or interpret content appropriately; or

  • Any deviation from accepted clinical standards or regulatory requirements.


To the maximum extent permitted by law:

  • Echo-Health is not liable for indirect, incidental, or consequential loss;

  • We do not guarantee uninterrupted access or error-free operation;

  • Your use of the Services is at your own risk.


11. De-identified Data Use

Echo-Health may use de-identified data for purposes such as product development, analytics, and reporting. De-identified data will not contain names or identifiers and will not be used to re-identify individuals.


12. Suspension and Termination

Echo-Health may suspend or terminate your access to the Services if:

  • You breach these Terms;

  • There is a legal or security risk;

  • Your subscription expires or remains unpaid. We will make reasonable efforts to notify you in advance.


13. Indemnity

You agree to indemnify and hold harmless Echo-Health from any claims, losses, or damages arising from your breach of these Terms, your unlawful use of the Services, or failure to comply with applicable clinical responsibilities.


14. Governing Law

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of that state.
